DEA Releases Rule on E-Prescribing of Controlled Substances

The Drug Enforcement Administration (DEA) has published a long-delayed interim final rule, with a comment period, to permit electronic prescriptions for controlled substances.* The rule is available through the Federal Register's public inspection site. It was officially published on March 31, and can go into effect 60 days later (as early as June 1, 2010). The rule permits pharmacies to receive, dispense and archive electronic prescriptions for controlled substances. The regulations, according to DEA, are an addition to, not a replacement of, existing rules governing controlled substances.

Through organizations such as the HIMSS Electronic Health Record Association (EHRA), LSS is actively participating in the public comment period (ending June 1) for the DEA rule. With our close partnerships with MEDITECH and collaborative e-prescribing solution vendors DrFirst, LSS is well positioned to help health care facilities benefit from use of the advanced e-prescribing tools. We will continue to closely follow the Federal regulatory processes regarding Health Information Technology incentives, meaningful use and certification in order to meet customers' e-prescribing, medical and practice management needs.

* Controlled substances are drugs that have the potential for abuse or dependence, including opiates, stimulants, depressants, hallucinogens and anabolic steroids. These drugs account for up to 20 percent of all prescriptions, according to various studies.
